The barriers to same-sex marriage in America received one more serious jolt Thursday. Oregon’s Attorney General Ellen Rosenblum told a federal judge she cannot, and will not, defend the constitutionality of a ban on gay marriage enacted as a constitutional amendment in 2004 by Beaver State voters. “The constitution has been violated in our opinion by this provision,” Rosenblum said in a statement. In a filing with U.S. District Judge Michael McShane, who is hearing a legal challenge brought by two couples, Rosemblum said: “State defendants will not defend the Oregon ban on same-sex marriage in this litigation.
